1. Agreement to Terms
By accessing or using GuestLoop ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Service Description
GuestLoop is a Guest Relationship & Rebooking Engine for vacation rental property owners. The Service provides:
- Digital guidebook creation and hosting
- Guest email capture and management
- Email and SMS marketing campaigns
- Booking management and analytics
- Integration with third-party booking platforms
3. Eligibility
You must be at least 18 years old and legally able to enter into contracts to use the Service. By using the Service, you represent and warrant that you meet these requirements.
4. Account Registration and Security
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to notify us immediately of any unauthorized use of your account
- We reserve the right to suspend or terminate accounts that violate these Terms
- You may not share your account or allow others to access it
5. Acceptable Use Policy
You agree NOT to use the Service to:
- Violate any laws, regulations, or third-party rights
- Send spam, unsolicited messages, or illegal content
- Harass, abuse, or harm others
- Distribute malware, viruses, or malicious code
- Attempt to gain unauthorized access to our systems
- Scrape, data mine, or harvest information without permission
- Impersonate others or misrepresent your affiliation
- Interfere with the proper functioning of the Service
6. Subscription and Billing
6.1 Pricing
Current pricing is available on our website. We reserve the right to change pricing with 30 days notice to existing subscribers.
6.2 Billing
- Subscriptions are billed monthly or annually in advance
- Payment is processed securely through Stripe
- Automatic renewal unless you cancel before the next billing cycle
- No refunds for partial months or unused features
- Failed payments may result in service suspension
6.3 Free Trial
We may offer a free trial period. After the trial, your subscription will automatically begin unless you cancel before the trial ends.
6.4 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access until that date.
7. Your Data and Content
7.1 Your Ownership
You retain all rights to the content you upload, create, or store in the Service ("Your Content"). This includes property information, guest data, guidebook content, and campaign materials.
7.2 License to Us
You grant us a limited license to use, store, and display Your Content solely for the purpose of providing the Service to you.
7.3 Your Responsibilities
- You are responsible for the accuracy of Your Content
- You must have the right to use and share Your Content
- You must comply with all applicable laws regarding guest data
- You are responsible for obtaining consent from guests for email/SMS communications
7.4 Data Backup
While we perform regular backups, you are responsible for maintaining your own backup copies of Your Content. We are not liable for data loss.
8. Intellectual Property
The Service, including its software, design, text, graphics, and other content (excluding Your Content), is owned by GuestLoop and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.
9. Third-Party Integrations
The Service may integrate with third-party platforms (e.g., Airbnb, Booking.com, Stripe). Your use of these integrations is subject to their respective terms and conditions. We are not responsible for third-party services or their availability.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS
- WE ARE NOT LIABLE FOR SERVICE INTERRUPTIONS, DATA LOSS, OR THIRD-PARTY ACTIONS
11. Indemnification
You agree to indemnify and hold harmless GuestLoop from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.
12. Termination
- You may terminate your account at any time by canceling your subscription
- We may suspend or terminate your account for violations of these Terms
- Upon termination, your access to the Service will cease immediately
- We will retain Your Content for 30 days after termination, then delete it
- Certain provisions (e.g., liability limitations, indemnification) survive termination
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of [Your State/Country], without regard to conflict of law provisions.
13.2 Arbitration
Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except for claims that may be brought in small claims court.
13.3 Class Action Waiver
You agree that disputes will be resolved on an individual basis and waive your right to participate in class actions or class arbitrations.
14. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email and posted on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.
